Terms of Use

The following words and terms have the following meanings:
1. Terms: means these Terms and Conditions;
2. User or Users: means any person accessing and using this website, the person who created the booking and clicked to indicate that they accept these Terms, including, but not limited to the Safety and Responsibility, and Voluntary Assumption of Risk, as well as any person who was booked by or through that person who created the booking, whether or not they contributed to the cost of the booking;
3. Venue: means the golf simulator facility located at 212 Metcalfe Street East, Strathroy, ON N7G 1P8

By accessing and using this website and the Venue, Users acknowledge that they have read, understood, and agree to comply with these Terms.
Users must follow all the rules, guidelines, and instructions provided in these Terms.

Bookings can be made only at this website (https://swingstationsstrathroy.ca/).
Bookings must be paid in full in advance by credit card.
Entrance to the Venue is allowed 15 minutes prior to the scheduled booking time.
Users will be granted an access code via Email and/or text message to the Email or text used for the booking.
Access code for the building will be sent via email and/or text message.
Users must exit the venue no later than 15 minutes after the scheduled booking time.
Cancellations can be accepted up to 24 hours prior to the scheduled booking time.
Any cancellations 24 hours prior to the scheduled booking time will result in a credit to the User who created the booking.
Refunds to credits cards must be requested via Email from info@swingstations.com within 48 hours from the cancellation.
No cancellations will be accepted within 24 hours of the scheduled booking time.

The golf simulator bays at the Venue are intended for recreational purposes only.
Users warrant and represent that they are in sufficiently good physical shape to participate in golf and are not aware of any condition that could prevent them from the safe participation of participation in golf and/or golf simulator activities.
Users are responsible for their own safety as well as the safety of others while using the Venue and golf simulator bays.
Users agree to conduct themselves with care in a safe and responsible manner, keeping in mind their surroundings and fellow users.

Users acknowledge that use of the golf simulator involves inherent risks, including but not limited to:
1. Physical injury from, among other things, swinging golf clubs, including strain, sprain and impact injuries from golf clubs and golf balls;
2. Physical injuries caused by contact with, among other things, golf simulator screens, walls, netting, etc.;
3. Physical injury from, among other things, slipping, tripping, or falling in the simulator bay or elsewhere in the venue;
4. Physical injury from, among other things, the conduct of other users;
5. Any other risk and physical and psychological injury inherent in the use of a golf simulator.
Users voluntarily acknowledge and accept these risks.
After scheduling a time through this website, Users will receive an Email with these Terms and a waiver via Email. All Users must accept the Terms and sign a waiver prior to receiving the access code noted in paragraph 8.

Users, on their own behalf and on behalf of themselves, their heirs, executors, administrators, agents, and assigns agree to release and hold harmless Swing Stations Inc., its directors, officers, management, employees, agents, and representatives from any liability for any claims, demands, actions, damages, causes of action, or losses arising from contract, tort, under statute, common law, and/or equity arising from the use of the venue and/or simulator bays.

Smoking including but not limited to tobacco, cannabis, vaping, e-cigarette, and other similar or related products is prohibited.
Consumption of alcoholic beverages, including but not limited to liquor, beer, wine, etc., is prohibited.

Outside food and beverage are permitted in the Venue. However, no food or beverage is allowed on the turf in the simulator bays
Users must clean up the simulator bay at the end of their booking. If a User finds any garbage, damage, etc., please report it to info@swingstations.com upon arrival.
Users are responsible for any damage to the Venue, including but not limited to simulator bay equipment, walls, fixtures, lights, etc.
Users cannot wear outside shoes or spikes on the turf.
Each simulator bay has a maximum capacity of 4 users.
Children under the age of 16 must be accompanied by an adult.
Children must be supervised at all times.

Swing Stations Inc. reserves its right to remove and/or eject Users without a refund for violation of the Terms.
Swing Stations Inc. reserves its right to ban future bookings from users who have breached the Terms.

Users accept financial responsibility for any damage to the Venue and/or golf simulator equipment, including but not limited to screens, netting, projectors, etc., caused by their misuse, negligent conduct, or violation of the Terms.

The Venue is monitored through audio and video recording 24/7 for the safety and security of the Venue and Users.
Users consent to being photographed or recorded during use of the Venue and the simulator bay.

Users agree to attorn to the jurisdiction of the Province of Ontario and any claim or dispute arising from these Terms or the use of the Venue and/or the golf simulator bays will be commenced in the Ontario Superior Court of Justice in London, ON.

The invalidity or unenforceability of any provisions of these Terms will not affect the validity or enforceability of any other provision Terms, which will remain in full force and effect.
